Desde su creación, este gran tribunal que surgió, tras la firma de los acuerdos de paz de la Habana, entre el gobierno del entonces presidente de la república, Juan Manuel Santos y la extinta guerrilla de las farc, ha sido tan polémico que cada vez que llegan noticias de esta super corte, no dejan de sorprendernos.
Ante la comparecencia de Elí Mejía Mendoza, conocido con el alias de Martin Sombra o el carcelero de las farc, en audiencia citada por la JEP, el día 13 de julio de 2023, en el caso de reclutamiento de menores, practica que llevo a cabo durante años esta agrupación ilegal, el compareciente Martin sombra, hizo una escalofriante confesión, la participación directa de las farc, en la masacre de Mapiripan Meta, ocurrida en el mes de Julio del año 1997, donde asesinaron a más de 49 personas.
Este crimen fue confesado por miembros paramilitares como Salvatore Mancuso, donde se allanaron su responsabilidad y recientemente también lo reconoció alias Otoniel, ambos comandantes paramilitares han coincidido que esta dolorosa masacre fue perpetrada por sus hombres en asocio y con ayuda de militares colombianos, en un dosier de pruebas recaudadas por la justicia que hasta el momento ha proferido sentencia sobre varios militares, entre ellos el general del ejército Jaime Uscategui.
El carcelero de las farc, Martin Sombra y sus camaradas están actuando al estilo del cuentecillo del pastorcito mentiroso, que, aunque confiesen sus verdades nadie se las va a creer, en especial sus víctimas, sombra narra que la masacre de Mapiripan fue cometida por una de sus tropas, llamado Marco Aurelio Buendía y desmiente y a la vez defiende la participación que haya tenido el general del ejército Rito Alejo del Rio, afirmando que el oficial es inocente en este crimen.
No es la primera vez que las farc son desmentidas por sus víctimas, recordemos las confesiones de los miembros del secretariado de esa organización criminal y su participación en el magnicidio de Álvaro Gómez Hurtado, los familiares del político colombiano han restado credibilidad a sus testimonio, lo cual nos conduce en el imaginario colectivo como sociedad que gracias a la benevolencia de la JEP, los criminales podrían estar encubriendo a los responsables de graves delitos, en una clara burla a la justicia y ensombreciendo el papel de la justicia especial para la paz (JEP).
EL rechazo que ha generado las declaraciones de Martin Sombra, por parte de familiares de las víctimas, colectivos de abogados, se suman las declaraciones del mismo general del ejército Jaime Uscategui, condenado por estos hechos, que no cree que las farc hayan sido los autores materiales de la masacre, por lo tanto debe ser un gran movimiento social que le exija a la JEP, la implementación de mecanismos que les permita llegar al fondo de la verdad y quien incumpla se someta a la justicia ordinaria.
Aquí nos hemos acostumbrado, a la hora de hablar de incumplimiento del acuerdo de paz, en un solo lado de la balanza, pero no solo el gobierno ha incumplido, quienes más lo han hecho son los exmiembros de las farc, faltando a la verdad.
A las farc se les entregaron 10 curules en el congreso, su propia unidad especial de protección, las garantías en el ejercicio de participar en política, sin aun responder por sus crímenes, proyectos productivos para los excombatientes, viviendas y la prelación en muchos espacios en donde las victimas se les trata con mezquindad de conocer la verdad, es esa misma verdad a la que algunos firmantes justifican para continuar su levantamiento en armas y continuar su prontuario criminal que mas tarde que nunca terminara en la creación de un nuevo tribunal de justicia especial, ensombreciendo la justicia de nuestro país.
