EL NUEVO EJECUTIVO SUS RELACIONES CON LOS ESTADOS UNIDOS

Estados Unidos ha sido históricamente nuestro mayor socio comercial en importaciones y exportaciones, exportamos hacia allá desde materias primas tales como café, flores, bananos entre otros  y a la vez productos energéticos como carbón y petróleo.

Con la aparición de la bonanza marimbera desde 1975 a 1985 se empezó con exportar hacia allá sustancias prohibidas convirtiéndose en un nuevo renglón en el mundo del comercio, esa bonanza no duro mucho tiempo si la comparamos con el flagelo de la cocaína que desde su aparición hoy en día nos ubicamos como el mayor exportador de esa sustancia a todos los continentes en especial en los estados unidos.

La muerte en prisión en una cárcel de los estados unidos el pasado 31 de mayo del 2022 del ex capo del cartel de Cali. Gilberto José Rodríguez Orejuelas a sus 83 años, debería llamarnos la atención como sociedad colombiana; que mediante mecanismos que nos ofrece la ley para participar en la toma de decisiones de orden nacional o generales, se debería exigir un análisis de fondo, sobre los artículos, 34 y 35 de nuestra constitución política, en especial el articulo 35 que dicta acerca de la extradición de nuestros connacionales.

El articulo 35 de la constitución política de Colombia dice “La extradición se puede solicitar, conceder u ofrecer de acuerdo con los tratados públicos y en su defecto, con la ley.”

La Constitución Política de Colombia reza en su “articulo 34 se prohíben penas de destierro y confiscación” salvo la extinción de dominio sobre vienes adquiridos mediante procedencia ilícita.

Con la muerte de Gilberto Rodríguez Orejuela, podríamos considerar, que el estado debe actuar en casos donde estén incursas personas de la tercera edad, no solo en cárceles de los estados unidos, también donde existan connacionales privados de su libertad y que padecen problemas de salud y repatriarlos en nuestro territorio colombianos.

Quien infringe a las leyes debe enfrentarse en juicio justo ante nuestros jueces de la república y el estado es el principal garante para que los derechos de los procesados no se violen o vulneren, es decir el estado no puede actuar en razón al delito que haya cometido el infractor y castigarlo con la misma gravedad, ya que eso constituiría una actuación violatoria a la misma ley.

El papel de la justicia es la aplicación de penas que corrijan las infracciones que cometen las personas con el propósito de la resocialización y adaptación de nuevo a la sociedad.

La suerte de muchos colombianos presos en las distintas cárceles del mundo se viene violentando lo consagrado en el texto constitucional, ya que algunos están muriendo en esas prisiones fuera de su patria.

Así quien gane la carrera por la presidencia de la republica y rija los destinos de los colombianos, no solo debe renegociar los tratados de libre comercio (tlc), también debemos exigirle reformular los tratados judiciales, en especial el de la extradición ya que vulnera al mismo texto constitucional.
