Como lo empecé a explicar en el artículo anterior, el control urbano en la ciudad no se está aplicando, principalmente porque a pesar de que la ley 1801 de 2016 (Código de Policía) nos da herramientas valiosas para que las inspecciones de policía a través de procesos verbales abreviados inicien sus procedimientos para sancionar infracciones urbanísticas, en nuestra ciudad a la hora de iniciar un proceso, sus etapas administrativa y policiva se encuentran divididas entre el Departamento Administrativo de Planeación, la Secretaría de Gobierno y las comisarías de policía. De esta forma, cualquier violación a las normas urbanas en Cúcuta, surte trámites entre diferentes oficinas que actúan desarticuladas, y que finalizan con los inspectores de policía, que ya sea por falta de recursos en sus respectivos despachos, desconocimiento o simple falta de interés (en el mejor de los casos), no están actuando e imponiendo las sanciones de ley, motivo por el cual, vemos que en nuestra ciudad pululan diferentes violaciones que van desde cosas tan sencillas como el irrespeto de los aislamientos requeridos en una construcción, hasta el complejísimo problema de las invasiones de terrenos. Lo anterior, sumado a que los cucuteños por alguna extraña razón no denunciamos lo suficiente, hacen que nuestra ciudad sea un caos en materia urbanística en donde prácticamente cada quien hace lo que quiere. Solo falta salir al frente de nuestra propia casa, y ver el perfil del andén, y podremos notar a qué me refiero.
Por lo anterior, mi propuesta está centrada en aprovechar una posible reorganización de las secretarías que podría estar pensando la administración municipal. De esta forma, y ante una posible eliminación de la Secretaría de Valorización y Plusvalía, la propuesta es optar, no por eliminarla, sino por transformarla en una Secretaría de Control Urbano, Espacio Público y Plusvalía, transfiriendo la responsabilidad del cobro de valorización a la Secretaría de Hacienda. La utilidad de esta nueva secretaría sería total. Se encargaría de recibir y tramitar las denuncias de infracciones urbanas a la ciudadanía, y como única encargada de este tema, podría coordinar y presionar a los inspectores de policía para que actúen diligentemente, cosa que no está pasando hoy en día.
Pero no solo sería una secretaría para recibir denuncias, sería la encargada de controlar el territorio urbano, vigilando por ejemplo que todas las construcciones de la ciudad se hagan efectivamente con licencia expedida por curadurías. Así mismo, que los constructores responsables de esas licencias, efectivamente construyan lo licenciado y no aprovechen las licencias para excederse y terminar haciendo lo que quieran. Por otro lado, también sería la responsable de cuidar el espacio público de la ciudad y administrarlo. No puede ser posible que hoy en día haya invasiones en sitios como el Centro Comercial Bolívar, en su ronda de río, y que nadie sea capaz de hacer nada en la administración municipal (y no solo en esta administración, ya que el problema viene desde hace más de tres años). Hace falta mano dura en este sentido. Estoy seguro de que esta nueva secretaría puede funcionar muy bien, porque tendría dientes y sus metas serían muy fáciles de medir. Es decir, la secretaría podría imponer multas a quienes cometan infracciones urbanísticas y hasta ordenar demoliciones previo cumplimiento del proceso legal requerido. Lastimosamente en nuestra ciudad no somos dados a aprender por las buenas, y tenemos que enseñarnos a que las reglas son para cumplirlas. Además, estas multas caerían muy bien al fisco municipal y permitirían ser invertidas por ejemplo en el mejoramiento y administración de espacios públicos icónicos como el Malecón o el Parque Colón.
Por no cumplir las reglas, hay muchas zonas de la ciudad que no se han podido intervenir para mejorar su espacio público, porque prácticamente no existe o está invadido. Invito al que lea este artículo a que se pasee por la avenida Las Américas o por la avenida principal del barrio Aeropuerto (por poner dos ejemplos muy sencillos) para que observe que el espacio en donde debería ir el andén para los peatones y personas en alguna condición de discapacidad, y hasta un espacio para las bicicletas, no existe y se encuentra completamente invadido por terrazas de discotecas, talleres, tiendas y comercios. Esta ciudad en donde prima el bien particular por encima del común no es una ciudad sostenible, y es esto precisamente lo que tenemos que corregir.

Claro que SI Juan Francisco, nuestra empresa vive a diario este comportamiento inadecuado de la población, se construye en zona de retiro y aún sobre canales ya construidos, es habitual no poder desarrollar proyectos de acueducto y alcantarillado xq nos encontramos con este tipo de obras prohibidas que se desarrollan sin control. Lo hemos informado permanentemente y durante años a la administración municipal y no se toma una decisión ejemplar al respecto. Tenemos confianza q esta si lo hará. BUENA PROPUESTA
