Es claro que desde el punto de vista filosófico, enunciados como el que “todos somos iguales”, para algunos es solo algo del imaginario popular, se percibe de manera equivoca que en la relación obrero patronal, existe un superior y un inferior, algo que es totalmente errado; lo primero que debemos entender es que solo existen roles, y que dentro de una organización empresarial, bien sea desde una micro empresa o una empresa multinacional, esos roles definen los grados o niveles de responsabilidad, dentro de los cuales existen claro está, alguien que debe ordenar, orientar e inclusive sancionar y otros cuyo rol esta más en el hacer; pero todos, absolutamente todos, son un engranaje de igual importancia para el crecimiento empresarial; para el ejemplo de una pequeña finca, el rol del campesino que ejecuta la labranza o del administrador que planea los momentos de siembra, la compra de insumos o la venta de los productos son igual de importantes o intenten pensar que pasaría con la finca si el obrero o campesino no está pendiente del proceso de labranza o que plagas están llegando al cultivo; o si el administrador no hace las compras de los insumos adecuados o a tiempo, o negocia mal la cosecha; en cualquiera de los dos casos el cultivo sería un fracaso.
Hoy se piensa en muchas organizaciones que no es necesario construir confianza entre las partes, que la credibilidad solo la debemos desarrollar hacia los proveedores y/o clientes, nada más equivocado; bien sea que es una micro o una gran empresa, los niveles de confianza y credibilidad de las partes son fundamentales, son un principio rector de las relaciones entre las partes, como lo son la administración de la empresa y los trabajadores, sean estos agremiados a un sindicato o sin esta representación.
Los procesos de negociación internos serán exitosos y menos traumáticos, si fortalecemos esa confianza, al punto que los administradores y los trabajadores lo crean así, la cual será muy beneficiosa cuándo lleguen las etapas de negociación, pues los trabajadores verán de manera tranquila cada una de estas etapas, con la seguridad que jamás serán asaltados en su buena fe; para ello solo se requiere un sindicato serio y claro en sus propuestas y una administración que emane confianza, que sea justa y firme en sus decisiones, así estas no necesariamente gusten a los trabajadores, solo que sean justas, cuantificables, sin sesgo y para todos por igual.
Los trabajadores deberán siempre entender que existe el poder subordinante o ius variandi, que no es más que la capacidad y poder del patrono de dictar las normas de la relación laboral; pero la administración debe entender claramente que este poder tiene límites, que jamás pueden violentar los derechos fundamentales del trabajador. Cuando este poder se utiliza de mala manera, ocurrirá la pérdida de credibilidad de los trabajadores en la administración, por ello no se debe abusar de la capacidad sancionatoria, siempre las sanciones deben no solo ajustarse a derecho sino adicionalmente ser éticamente correctas y el último recurso empresarial, primero siempre el dialogo.
Cuando se sanciona de manera injusta y se evalúa por la administración, que fue injusta esta sanción, crecerá inmensamente la credibilidad de este si se corrige; si en cambio se espera fallo de la justicia laboral y este sale favorable al trabajador, se pierde cualquier posibilidad de crecimiento y confianza de las partes. Tampoco sirve la confabulación entre los dirigentes sindicales y los dirigentes empresariales, pues se pierde credibilidad en las partes, por parte de los trabajadores de base, pero también si esta confabulación es pública o excede el ámbito de la empresa se perderá o resquebrajará la confianza en la organización empresarial por parte de proveedores y clientes.
Podemos ver casos que públicamente se han ventilado últimamente, como el caso de Comfanorte, donde una insana alianza político-empresarial-sindical, ha ocasionado un daño reputacional alto; al permitirse el despido injustificado de trabajadores y ahora que empiezan a salir los fallos de la justicia en contra de la administración, queda lastimada no solo el grupo mayoritario de empleadores que respaldan a la casa política a la cual le fue entregada la entidad, sino lamentablemente queda mal parado un sindicato, cuyos dirigentes miraron para otro lado mientras se masacraban trabajadores. Los que tenían fuero podrán ganar los procesos (como ya ha ocurrido recientemente); pero los que tenían contratos a término fijo y que habían sido participes del crecimiento de esa caja les quedará más difícil ganar un proceso de reintegro cuando desde el punto de vista legal no fueron despedidos, sino que no se les renovó el contrato. Figura legal pero no ética.
Por ello siempre debemos llamar a la mesura y ponderación en la toma de decisiones, estas deben ser siempre evaluadas y de ellas debemos tomar las enseñanzas que permitan que las partes crezcan de la mano, lo más difícil es reconstruir confianzas, por aquello que “al picao de culebra las lagartijas lo asustan” las inversiones que se hacen en construcción de confianza y credibilidad no pueden ser solo enunciados y dineros perdidos, deben ser cimientos para la construcción permanente de vías de dialogo fuertes para las partes. La palabra empeñada, como decían nuestros ancestros debe tener gran valor, la comunicación empresarial debe ser clara, asertiva, seria y objetiva; no puede ni debe, existir sesgos en la aplicación de la política laboral; firmeza, ponderación y humanidad elementos mínimos para este éxito.
