LOS NUEVOS RETOS DE LAS EMPRESAS ANTE LA NORMATIVIDAD AMBIENTAL

Existen varias leyes y normatividad en el marco regulatorio de Colombia que establece tributos o aportes según la actividad económica desarrollada por las empresas, las cuales corresponden a compensaciones ambientales con el ánimo de contribuir al cuidado de los recursos ecosistémicos y minimizar el impacto generado por el desarrollo productivo.

Ahora bien, el pasado 30 de diciembre se firmó la Ley 2173 de 2021, “Por medio de la cual se promueve la restauración ecológica a través de la siembra de árboles y creación de bosques en el territorio nacional, estimulando conciencia ambiental al ciudadano, responsabilidad civil ambiental de las empresas y compromiso ambiental a los entes territoriales; se crean las áreas de vida y se establecen otras disposiciones”; esta norma tiene como objetivo la creación de Áreas de Vida, en las que se pretende incentivar la siembra de árboles en todos los municipios del país. El fin último de la norma es involucrar a la población y a las empresas en la restauración ecológica del territorio.

Ahora bien, aunque a esta ley le falta un proceso de reglamentación por parte del Estado, es importante resaltar a los ciudadanos y las empresas que la restauración va más allá de solo sembrar árboles. Es necesario la regeneración de suelos, la conservación de polinizadores y el desarrollo de modelos de negocio amigables.

Si bien esta ley tiene muchos puntos positivos, porque empieza a orientar a las empresas en la dirección de contemplar la visión de los bosques, los paisajes y los servicios ecosistémicos, no lo hace de una manera integral.  Dentro de la Ley, se establece que las medianas y grandes empresas deberán sembrar mínimo dos árboles por trabajador, esto con el apoyo de las autoridades ambientales de todo el territorio nacional. Estas últimas serán las encargadas de definir lo que en la Ley se denominan “Áreas De Vida”, es decir, los predios estratégicos donde se deben hacer estas siembras e intervenciones.

Por otro lado, en la reglamentación se contempla un gran desafío para los municipios y autoridades ambientales del país, entidades que tendrán que contar con un equipo técnico para garantizar el éxito en la implementación de la Ley, ya que se trata de garantizar a las empresas y ciudadanos que los lugares de siembra son idóneos.

Desde otra perspectiva, sería complementario haber contemplado desde la ley otras acciones a través de las cuales las empresas y ciudadanos puedan participar en la restauración de ecosistemas; por ejemplo, además de la siembra de árboles, podría orientarse la movilización de recursos, como medida de compensación de huella de carbono, hacia actividades de educación para la restauración de ecosistemas o acciones de adaptación ante el cambio climático en zonas rurales, en donde los fondos de agua como vehículo articulador pueden ser de gran ayuda para el logro del objetivo propuesto.

Por último, la Ley 2173 de 2021 entrará en vigencia el 1 de enero de 2023; aún quedan algunos meses para que el Ministerio de Ambiente y Desarrollo Sostenible finalice la reglamentación requerida para su implementación.  Existen muchas oportunidades para los diferentes actores en su correcta implementación como un mecanismo útil para las acciones concretas en los ecosistemas estratégicos de cada territorio.
